Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites metabafit.com and ryanengelfit.com and related products and services provided by Buckley Carlyle LLC d/b/a RE Fitness (“RE Fitness,” “we,” “us,” or “our”). By using our websites, booking an appointment, submitting an application, purchasing any product or service, or opting in to communications, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

1) Eligibility & Accounts

You must be at least the age of majority in your state or country to use the Services. If you create an account, you are responsible for maintaining its security and for all activities that occur under it. Provide accurate, current information and update it as needed.

2) Services; No Medical Advice

RE Fitness provides fitness coaching, educational content, and related services. We do not provide medical, nutritionist, or licensed healthcare services. Information is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before beginning any fitness, nutrition, or wellness program. Participation is voluntary and at your own risk.

3) Applications & Bookings

Some bookings may require you to submit an application and/or place a deposit to hold your appointment. Specific deposit and reschedule/no-show terms will be shown at checkout or in your booking flow and control if an appointment is missed or changed.

4) Purchases, Billing, Cancellations & Refunds

Prices, promotions, and availability may change without notice. You authorize us (and our payment processors) to charge your selected payment method.

Refunds depend on the specific offer purchased:

  • Products (digital or physical): Most products include a 30–60 day refund window, as stated on the relevant sales/checkout page for that product. The specific timeframe and any conditions shown at purchase govern.

  • Service-based services (e.g., coaching/consulting): Fees for services already delivered are non-refundable.

    • Subscriptions (monthly or recurring services): You may cancel future payments at any time before the next billing date via your account portal (if available) or by emailing team@ryanengelfit.com. Cancellations apply prospectively and do not refund prior charges unless expressly stated in the offer terms.

  • Offer-specific guarantees: If a guarantee is presented for a particular offer, the terms on that offer’s page/checkout control (including any eligibility requirements and deadlines).

We may suspend or terminate access for non-payment or suspected fraud. Chargebacks may result in immediate account suspension.

5) Communications; SMS/MMS Terms

By providing your contact information, you consent to receive operational emails and calls about your application, booking, or account. Marketing messages require your separate consent.

Text Messaging Program. If you opt in (e.g., by checking an unchecked consent box on our forms or texting a keyword), you agree to receive SMS/MMS messages from RE Fitness relating to applications, bookings, reminders, account updates, and limited promotions.

  • Message frequency: varies.

  • Cost: message & data rates may apply.

  • Opt-out: reply STOP (or END, CANCEL, UNSUBSCRIBE, QUIT) to stop. One final message confirms your opt-out.

  • Help: reply HELP or email team@ryanengelfit.com.

  • Consent is not a condition of purchase.

  • Delivery: carriers are not liable for delayed or undelivered messages.

  • We use links on our own domains and do not use public URL shorteners in program messages.

Mobile information: We do not share mobile numbers, opt-in data, or consent with third parties for their marketing or promotional purposes. See our Privacy Policy for details.

6) Acceptable Use

You agree not to misuse the Services, including by violating laws, infringing rights, posting harmful or misleading content, attempting unauthorized access, or interfering with security or operations. We may suspend or terminate access for violations.

7) Intellectual Property

All content on the Services—including text, graphics, videos, logos, and software—is owned by RE Fitness or its licensors and protected by law. You may not copy, modify, distribute, or create derivative works without prior written permission. We grant a limited, revocable, non-transferable license to access and use the Services for your personal, non-commercial use.

8) Testimonials & Results

Testimonials reflect real client experiences but do not guarantee similar results. Individual outcomes vary based on many factors, including adherence, health status, and effort.

9) Third-Party Services

We use third-party providers (e.g., hosting, analytics, messaging, payments, CRM). Those providers may have their own terms and privacy policies. We are not responsible for third-party websites or services.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RE FITNESS, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 3 MONTHS BEFORE THE EVENT.

12) Indemnification

You agree to defend, indemnify, and hold harmless RE Fitness from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.

13) Changes to the Services and Terms

We may modify or discontinue any aspect of the Services at any time. We may update these Terms from time to time; the “Last updated” date shows the latest version. Continued use after changes means you accept the revised Terms.

14) Governing Law; Disputes

These Terms are governed by the laws of the State of California, without regard to conflicts of law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction and venue. You and we waive any right to a jury trial to the extent permitted by law.
